01The agreement
These terms govern your use of the Garden Heights Community website and league platform. By creating an account or using the platform you accept them. If you do not accept them, do not use the platform.
The platform is operated by Garden Heights Community, referred to below as “we” or “the league”.
These terms cover the software. Playing in the league itself is also governed by the league rules and by the waiver you sign before playing; where the waiver and these terms overlap, the waiver governs anything to do with physical participation.
02Accounts and eligibility
- You need an account to use anything beyond the public pages. Give us accurate information and keep it current.
- One account per person. Do not share your sign-in details or let anyone else use your account.
- You are responsible for what happens under your account. Tell us promptly at [email protected] if you think someone else has access to it.
- You must be 18 or over to hold an account. Under-18s may play with a parent or guardian’s signed waiver.
- Commissioners can create unclaimed player records so that games can be scored before everyone has signed up. Claiming such a record and attaching it to your account makes you responsible for it.
03Playing in the league, and physical risk
Basketball carries a real risk of injury. Nothing in the platform reduces that risk, and taking part in league play is your own decision.
Before you play you will be asked to read and electronically sign the league waiver. That signature is legally binding in the same way a handwritten one is. We record the time you signed and the IP address you signed from, and we keep a copy of the signed document.
The platform gives no professional advice
Statistics, ratings, scouting reports, training suggestions and anything else the platform produces are informational. They are not medical, health, fitness, legal, financial or professional advice of any kind. Speak to a qualified professional before acting on anything you read here, particularly regarding injury or fitness to play.
04How to behave here
This is a community of people who see each other on the court every week. Use the platform accordingly. Do not:
- harass, threaten, bully or abuse another member, in messages, feed posts, comments or anywhere else;
- post content that is hateful, sexually explicit, or that targets someone for who they are;
- impersonate another person, or claim a player record that is not yours;
- upload photos or video of someone in a way they would reasonably object to, or share media from the league outside it in a way that embarrasses a member;
- falsify statistics, tamper with scoring, or misuse commissioner tools;
- attempt to access accounts, data or parts of the system you are not entitled to, scrape the platform, or interfere with its operation;
- use the platform for advertising or commercial solicitation.
Report anything that breaks these rules to a commissioner or to [email protected].
05Your content
Messages you write, posts you publish and files you upload remain yours. You keep ownership of them.
By posting or uploading, you give the league permission to store, display and distribute that content within the platform for the purpose of running the league — showing your post in the feed, showing your photo on your profile, including a clip in the media library. You confirm that you have the right to upload what you upload.
We do not sell your content, licence it to advertisers, or use it to promote anything outside the league without asking you first.
06Photos, video and likeness
League games are photographed and filmed. Commissioners upload that media and tag the players in it, which means media of you may be posted by someone else and shown on your profile and in the league media library.
If you want a photo or video of yourself taken down, contact a commissioner or email [email protected], and we will remove it.
Photos and video taken at league games may appear on this platform and on the league’s own social accounts. Tell a commissioner if you would rather not appear and we will remove you.
07Statistics, ratings and automated reports
Statistics are recorded live by people, during games, at speed. Mistakes happen. Box scores, averages, standings and every rating derived from them are provided as-is, and a commissioner may correct them after the fact.
Scouting and development reports are generated automatically by an AI model from those recorded statistics, as described in the Privacy Policy. They are automated commentary on numbers, not a professional assessment of any player, and they may be wrong or unflattering. Do not treat them as a judgement of anyone’s ability or character.
Where a league enables public scouting reports, other members of that league can read the report generated about you.
08Commissioners and league decisions
League commissioners run drafts, rosters, trades, scheduling, scoring, discipline and awards. Their decisions on league matters are final within the league. The platform records those decisions; it does not arbitrate them. Disagreements about a call, a suspension or a roster move go to the commissioner, not to the software.
09Fees
The platform is free to use. There is no subscription and no paid tier, and the software takes no payments — it has no payment processing of any kind connected to it.
Any fees to play in the league — season dues, team fees, equipment — are set and collected by the league directly. This platform does not process payments.
10Availability
We run this platform for our own league and we try to keep it up, particularly on game nights. But we make no uptime commitment. The platform may be unavailable for maintenance, because a third-party service we depend on is down, or without warning.
Features can change or be withdrawn. Statistics and media may be lost if something goes wrong, so keep your own copy of anything you would be upset to lose.
11Our intellectual property
The Garden Heights Community name, logo, site design and software are ours. These terms give you permission to use the platform as a league member; they do not give you any right to copy, rebrand, resell or reuse the software or the branding.
12Suspension and termination
You can stop using the platform at any time, and you can ask us to delete your account — see the Privacy Policy for how that works and what survives it.
We can suspend or remove an account that breaks these terms, that harms another member, or where the person has left the league. Where it is reasonable to do so we will tell you why.
13Disclaimers and limits of liability
The platform is provided as is and as available, without warranties of any kind, to the fullest extent the law allows. We do not warrant that it will be uninterrupted, error-free, or that the data in it is accurate or complete.
To the fullest extent permitted by law, the league and the people running it are not liable for indirect or consequential loss, for lost data, or for anything arising out of your use of the platform. Nothing here limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, or for fraud.
Liability relating to physical participation in league play is governed by the waiver you sign, not by this section.
14Governing law and disputes
These terms are governed by the laws of the State of New Jersey, United States.
Before anything formal, please contact us at [email protected]. Most things are resolved with a conversation.
15Changes to these terms
We may update these terms as the platform changes. The date at the top of this page shows the last revision, and material changes will be announced in the app. Continuing to use the platform after a change means you accept the revised terms.
